A second conviction for the same offense is punishable by up to 1 year in county jail. Lastly, the third conviction can result in both a felony conviction and a prison sentence.

The DMV has a strict rule for those who are convicted on multiple offenses of driving with a suspended license. If you are convicted of 3 driving while your license is suspended charges within a 5 year period, you can potentially be classified as an habitual traffic offender (HTO), resulting in a revocation of your license for 5 years. This HTO status can occur even if the citations were only civil infractions. In other words, even if you did not have knowledge that your license was suspended, if you received an adjudication on the infraction it will count towards one of the three convictions needed for an HTO status. If you have been classified by the DMV as an habitual traffic offender, any subsequent offense for driving with a suspended license during the five year revocation period can be charged as a felony.
